Terms of Use (SafeEat)

Welcome to SafeEat, developed and maintained by FJCode OÜ (Reg. No. 16993109, registered address: Viru väljak 2, 10111 Tallinn, Estonia) (the "Company", "we", "us", or "our"). These Terms of Use (the "Terms" or "Agreement") govern your access to and use of the SafeEat mobile application (iOS/Android), any related websites operated by the Company, and related services (collectively, the "Service").

Please read these Terms carefully. If you do not agree, do not use the Service.

1. Definitions

  • "Company", "we", "us", "our" - FJCode OÜ.
  • "User", "you" - any individual or legal entity using the Service.
  • "Service", "Application", "App" - the SafeEat application, Company websites, and any related tools and features.
  • "Content" - any information or materials uploaded, submitted, scanned, stored, generated, or displayed through the Service (including photos, images, text, menu items, labels, results, and user inputs).
  • "Health Profile" - information you provide about allergies, intolerances, dietary restrictions, chronic conditions, preferences, or other nutrition/health-related settings.
  • "Third-Party Services" - third-party platforms, SDKs, app stores, payment processors, analytics providers, or websites that may be integrated with or linked from the Service.

2. General Provisions

2.1. These Terms form a legally binding contract between you and the Company. By using the Service, you agree to these Terms.

2.2. We may update these Terms from time to time. The updated version will be published in the App and/or on our website(s) with the "Last Updated" date. Your continued use of the Service after changes become effective means you accept the updated Terms.

2.3. Additional policies may apply, including our Privacy Policy. If there is a conflict, these Terms govern unless mandatory law requires otherwise.

3. Eligibility and Age Restrictions

3.1. The Service is not intended for children under 13.

3.2. If you are under 18 (or the age of legal majority where you live), you may use the Service only with permission and supervision of a parent or legal guardian.

3.3. By using the Service, you represent that you meet the eligibility requirements above.

4. Purpose of the Service (Important Disclaimer)

4.1. SafeEat provides informational guidance only. The Service uses AI/OCR and other automated methods to analyze what you scan (e.g., ingredient lists, nutrition labels, barcodes, dishes, and restaurant menus) and compare it with your Health Profile.

4.2. SafeEat is not a medical device and does not provide medical advice. The Service does not diagnose, treat, cure, or prevent any disease. You should consult a qualified healthcare professional for medical advice, diagnosis, treatment, and for managing allergies, intolerances, or chronic conditions.

4.3. No guarantee of safety. Food safety depends on many factors outside the Service's control, including (but not limited to):

  • hidden or undeclared ingredients,
  • cross-contamination / cross-contact (e.g., shared equipment, fryers, oils),
  • recipe changes by manufacturers or restaurants,
  • incomplete or inaccurate labels/menus,
  • user-specific sensitivities, unknown allergies/intolerances, or evolving medical conditions.

4.4. You are responsible for your choices. Any decision to consume a product or dish is made solely at your own discretion and risk. If you have severe allergies or are at risk of anaphylaxis, do not rely solely on the Service.

5. Acceptable Use and Restrictions

5.1. You agree to use the Service lawfully and responsibly.

5.2. You must not:

  • reverse engineer, decompile, or attempt to extract source code except where permitted by mandatory law;
  • bypass or interfere with security features, access controls, or rate limits;
  • use bots/scrapers to overload or extract data from the Service;
  • upload malware or harmful content;
  • use the Service to infringe others' rights, including privacy and intellectual property rights;
  • submit content you do not have the right to use (e.g., third-party personal data without consent).

5.3. We may suspend or terminate your access if we reasonably believe you violated these Terms or misused the Service.

6. Registration and Accounts (if applicable)

6.1. Some features may require an account. You agree to provide accurate and up-to-date information if requested.

6.2. You are responsible for maintaining confidentiality of your credentials and all activity under your account.

6.3. If you suspect unauthorized access, contact us immediately at support@safeeat.app.

7. Paid Features, Subscriptions, and Payments

7.1. The Service may include paid features (subscriptions or in-app purchases). Pricing and billing terms are displayed in the App and in the relevant app store.

7.2. Payments and subscription management are handled by the platform where you purchased (e.g., Apple App Store or Google Play). The Company does not store your full payment card details when payments are processed by the app stores.

7.3. Renewal, cancellation, and refunds are governed by the policies of the platform of purchase and applicable law. You can cancel subscriptions through your Apple/Google account settings; access typically remains until the end of the billing period.

8. Content and Intellectual Property

8.1. Your Content. You retain ownership of Content you upload or provide. However, you grant the Company a limited, worldwide, non-exclusive, royalty-free license to host, store, copy, process, analyze, display, and use your Content solely to provide and improve the Service, consistent with our Privacy Policy.

8.2. De-identified / aggregated data. We may use aggregated and/or de-identified information to improve the Service, develop features, and generate statistics, as described in the Privacy Policy.

8.3. Company IP. The Service, including software, algorithms, UI/UX, trademarks, logos, and proprietary materials, is owned by the Company or its licensors and protected by applicable intellectual property laws. You receive a limited, personal, non-transferable license to use the App for its intended purpose.

9. Privacy

9.1. Our processing of personal data is described in our Privacy Policy.

9.2. By using the Service, you acknowledge that certain data (including Health Profile inputs and scan content) may be processed to provide personalized results, subject to the Privacy Policy.

10. Third-Party Services and Links

10.1. The Service may include links to third-party websites or integrate third-party services (e.g., analytics, crash reporting, subscription management, cloud infrastructure).

10.2. We do not control third-party services and are not responsible for their content, availability, or privacy practices. Your use of third-party services is governed by their own terms and policies.

11. Disclaimer of Warranties

11.1. The Service is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory.

11.2. We do not warrant that the Service will be uninterrupted, error-free, accurate, or meet your expectations, or that results will be complete or suitable for your specific situation.

12. Limitation of Liability

12.1. To the maximum extent permitted by applicable law, the Company will not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of (or inability to use) the Service.

12.2. Food decisions are your responsibility. The Company is not liable for outcomes resulting from reliance on the Service, including allergic reactions, health complications, or other damages related to eating decisions.

12.3. To the extent permitted by law, the Company's total liability for any claims related to the Service will not exceed the amount you paid to the Company (if any) for the Service in the six (6) months prior to the event giving rise to the claim.

12.4. Nothing in these Terms limits liability that cannot be limited under mandatory consumer protection laws.

13. Suspension, Modification, and Termination

13.1. We may modify, suspend, or discontinue the Service (in whole or in part) at any time.

13.2. We are not responsible for any losses resulting from such changes, except where required by law.

13.3. You may stop using the Service at any time.

14. Governing Law and Dispute Resolution

14.1. These Terms are governed by the laws of Estonia, unless mandatory local law provides otherwise.

14.2. Any dispute that cannot be resolved amicably will be submitted to the competent courts at the Company's place of registration, unless mandatory law requires a different forum.

15. Miscellaneous

15.1. If any provision is found invalid or unenforceable, the remaining provisions remain in effect.

15.2. Our failure to enforce any provision is not a waiver of our right to enforce it later.

15.3. You may not assign your rights or obligations under these Terms without our prior written consent.
